It depends on the state. There was actually a recent story about this, where two kids who had consentual sexual contact were both charged with sex crimes.
Kwaad wasn't trolling, he was just completely tactless. I don't think this was reason to ban him. I certainly don't think "just leave please" is a valid reason to ban him, either. The "reason for ban" field is not there so you can make fun of the people you ban, it's there so that the rest of the community can see why someone was banned. This isn't the first snide comment I've seen in that field, either.
