It can't be, because her son hadn't reached age of consent to start with. That's the law, regardless whether the person is mature enough (which, in this case, I don't think he was anyway).
Googled Michigan law, and unless the info I found was wrong, it's up to 15 years for sex with a minor between 13 and 16 years. For her to get up to 30, incest must have played a role as well.
