In Australia, we "layby" items all the time. It means you have fully paid for an item to get it at that price and then pick it up when it comes in or pick it up when both parties agree is a convenient time.

Not really.  A lay-by is not a pre-order.  A lay-by often doesn't allow you to pick the item up, but rather holds it until you have incrimentaly paid if off.

But with pre-orders, you only have to put $10 down at EB, and I think $5 down at JB.

You can get that back too I think.  Basically, if there is a substantial price move, you can be sure they have to factor it in.  Indeed, EB for example offers a price match promise.  If the price is cheaper anywhere else on the day, you get the game for that price.

Yeah I get that and usually fairness prevails due to most stores having such a policy, but if I pre-ordered a product at a store that store may have a policy that the price is locked in. Put it this way, it's not illegal for them to do that.I am not sure about the legalities of holding a deposit either.

All I am saying here is that every outlet has got Kinect at 150.00. Even the MS site. I find it highly unlikely that MS will do a surprise move by lowering that price at release. It's wishful thinking and I hope that I am proven wrong.
