I totally agree.
That being said, I just deliberately changed the orientation of my Xbox a few times while a DVD was spinning in the drive (something I never do normally) and... nothing happened. No scratches.
It looks like MS sourced OEM drives without the rubber bumpers that have been in use since the Zephyr (2nd) model 360s.
They should probably fix that in subsequent batches or there will be more scratched disks and naturally, more people howling at their own stupidity for not reading that label.
