Honestly, it's always seemed like Sony knew about the whole Final Fantasy XIII thing before it happened and MS know that when their exclusivity contracts run up that Sony will snatch up their games and then add in features. It's common practice between the two.
I really do think there is a chance that each company can get out a few surprises out of the box though but it's not as common as we think.

yes about the FF13 thing as they would have had an exclusivity thing so to break it,SQ will need to tell SONY
if if no contract,Square Enix will tell so that SONY doesn't advertise or showcase it as exclusivity as it was announced as exclusive
MGS RISING which was not announced for anything can be announced by KONAMI and Microsoft without even informing SONY but they woul as KOJIMA's relations with SONY are good so that it doesn't shock them

I don't know. I would assume that the company would have to be upfront about what systems the game is coming out for. Otherwise, the company might assume it's an exclusive. Of course then again, Microsoft seemed to believe Metal Gear Solid Rising was an exclusive when they first announced the game.

but when MS announced MGS RISING they knew it wasn't exclusive as theyn would brag about it then and that they would have emphsized on that fact
they would have a contract with KONAMI,it is not they they mae a contract with KONAMI,paid them and then KONAMI announces it for PS3 too.
