And this was why I stopped posting in this thread.
I knew I was right, I had proof via email, people wouldn't believe it... so it was just a matter of waiting for the firmware to ship to developers and waiting for a game to require it.
So yeah. I was right.
As for whether this will effect the lawsuit... once again, it depends on the nebuleous often up in the air rulings of judges.
