Well, you choose between the free service Sony does not have to offer or Linux, its all good. If you dont want to accept the agreement then Sony restrict you from accessing their free online service that didnt came with your PS3 purchase. They can restrict PSN to anyone anytime, it shouldnt be a concept too hard to understand. Sega didnt support a dreamcast store nobody sued them because of that. If you want to push that farther, in about 15 years, when the PS3 will be almost forgotten, Sony will probably close their whole PSN servers restricting access to everyone, do you really think people could sue them and win?
Sony is not force legally to offer PSN, hence they can restrict the access as they please. Thats what they are doing. They are not removing Linux from you, they are removing PSN (their free service they are not leggaly forced to offer). You are removing Linux from yourself if you select to update to keep PSN. PSN wasnt part of your PS3 purchase. Maybe in your mind but not on paper.
