Just one major problem with your logic here. Hacks are designed to access functions within a device which were either not available at the time of sale or not marketted to work with a certain device. As the "otherOS" function was both present when units were sold and marketted as a feature of the PS3, if the CFW is designed to metrely restore the "otherOS" then it is merely restoring a feature which owners of the console were entitled to to begin with (in the case of older model PS3 owners). As such CFW which was specifically designed to work around FW3.21 cannot be classed as a hack. If anything, as Sony have acted illegally in many countries under consumer protection laws, legally this CFW would have to be classed as indirect restitution.
Furthermore if you want to blame anyone for CFW coming to the PS3, blame Sony for thinking that they were big and bad enough that the consumer protection laws of countries they export to, simply don't apply to them.
