Actually Sony in the case of Australia has broken several sections of the TPA- section 52, 53c, 68, 70 and 74 by this course of action. This is why PS3 owners here have been legally advised by the ACCC and other legal advisory services to launch criminal proceedings against Sony. It's also why the ACCC has indicated in a form letter to people complaining to them (the type of email which only gets sent out when there are several people complaining) that they are seriously investigating the matter- if you think that's something which happens in the course of a few days then you clearly lack even the most basic understanding of how a case of this scale works, including legal preparations. Nice try, but but you fail- go to jail, go directly to jail, do not pass go, do not collect $200.

Yes because this situation doesn't also affect users 6-12 months from now when games will start coming out requiring that version of firmware or higher in any way whatsoever. Seriously do you even engage your brain at all before letting your fingers go nuts on the keyboard?

I Challenge you to post a pic of your PS3 running linux with your VGC screen name visible along with something onscreen that proves its running on your PS3 or stop your personal crusade.
