To everyone saying that my sister is a bad dog owner, keep it in mind that the dog is not her's. The dog belongs to my mother and father.
New York State Law also states that now the dog will be labeled as a "Dangerous Animal" and if he unfortunately attacks again he will not only forced to be put down, but my parents would also get a $1,000 fine as well as 90-days in jail.
Food for thought in regards to those on the dog's side.
Also bear in mind that the dog has a habit of growling at not only my niece, but to my 10 year old cousin, my niece's 5 year old step brother and my 4 1/2 year old nephew.
Do we blame all of them too?
The dog is getting old and ever since his hernia surgery where he also had his testicles removed he has had a completely different personality. Sometimes he is a mush and sometimes he is a mean son of a bitch.
This could have been anyone's kid and not just my sister's.
While I do not deny that my sister is to blame for allowing my niece to hit the dog, the dog is still becoming quite an issue, especially in a home where my 9 1/2 month old daughter is living.
Plus, how do you teach a 2 year old to not walk over to a dog or pull it's tail, hair, etc...? Even my daughter now likes to grab the small dog by the hair. Remember, these are very little children who really do not know any better.

Yeah... I'm still on the dogs side. By no means should your sister's kid be taken away... but it's a much more just solution then punishing the dog. That's for sure.
It's just like the conversation we had in the other thread on which you agreed with. About hackers and the people who do bad things with them.
It's not the Hackers or the Firmwares fault... it's the people who pirate.
It's the exact same situation here.
My aunt had a 2 year old... and she succesfully taught her 2 year old to not antagonize their dogs... so it is possible, and even if it wasn't... it's a simple thing to teach the kids not to go near the dog... or just keep the animals away in general.
Lots of people have young children and animals so it's surely possible.

I am not saying it isn't my sister's fault, because I know it is, but the dog is still agressive to any child that sets foot at the house.
As a parent I would never side with an animal like that.

A woman who is abused by men can often develop a disorder where she is agressive to any man that aproaches her.
I think you said it best when you said "As a parent." I think you are letting your parenthood blind yourself on the issue. Which is understandable considering the importance of child raising in someones lives, but still, I think it's effecting your judgement, much how people want all violent videogames banned etc.
I don't think humans should have equal rights as animals all for animal testing and things that benefit man kind, but you are generally talking about destroying an animal for no real reason other then misuse by the owner and a general piece of mind.
It's no better then just going out with a bebe gun and shooting cats and birds.
There are plenty of ways to be responsible with animals in the house plenty of people do it.

He got the surgery about a year ago, long before my niece was even able to antagonize him, before she could even walk.
Even then he would snarl and growl at children.
It is something we should have picked up on and acted upon long ago.

Which still doesn't change the underlying issue that it's something you guys should of picked up and acted on quite honestly. I can't ever see putting down a dog because of it's owners mistake. Like I said, it's no better then shooting random animals with bebe guns.
