you are granted a License to use it.!

that is the very same thing with the XMB, sony own's the XMB not the consumer.

did you not take the time to read about service pack 2 and the loss of some consumer's software functionality that worked just fine on service pack 1.

did Microsoft get a lawsuit over this?

that should tell you something.

just because Amazon gave someone a refund does not mean everyone will!
