Actually, someone on the EU Playstation blog said that they went to their local small claims court in order to get a full refund for their PS3 this morning; we'll see how that goes. I myself will wait until that 3.21 update actually arrives and then decide what to do. Given that the EU directive I quoted above has been adopted by national law in all EU countries, the small claims court thing might actually work.
