Atleast for Max Payne 1, it's on the Backwards Compatability list.
You can either pop your disk in, when on Xbox Live, and it'll load Max Payne up in about 10 seconds (after a small download), or you can request the Backwards Compatability disk from Microsoft, that has the current software for every game on the Xbox BC list.
