The general mentality of most third party publishers is why should they spend the time (24 months) and money ($20 Million+) to make a good Spiderman game when they can rush it out the door (12 months) at a fraction of the cost ($5 Million) and sell roughly as many copies ...

This is the general reason licenced games usually suck, the Publisher buys rights to the licence because they know they will be able to sell enough games regardless of the quality of the game. On occasion they farm the title out to a good developer or the movie gets delayed (providing extra development time) and the game turns out well, but that seems to be rare.
