Nintendo caught him on the GBAtemp forums, he was stupid enough to upload pictures of his game and receipt after uploading the game. Nintendo would have never caught anyone if he uploaded it through conventional channels as a scene release.
He was even more stupid for settling out of court, there was no advantage in accepting a AU$1.6million penalty.
