Being that you are in CAnada, you warranty should not be hard to take advantage of in case something does go wrong.

Xbox has a lot of quality games, probably most out of all 3 systems this gen and the cool thing about them is that they are dirt cheap for older classic titles. Things you need to get to enjoy xbox to the fulest are:

HD TV...a 32 inch 720p Dynex does the job wonderfully if you don't have one. Best buy had them for 299 few weeks ago.

Online servince with xbox live. You get 1 free month with your xbox but after thats its 40-50 bucks a month, depending the deal you find on kijiji, craigslist


Haha no risk? Really? Be reasonable man. Saying NO risk is crazy even for a NEW 360. Actually, if u said there was no risk in a used ps3 that would still be unreasonble bc, even though ps3's are generally reliable, u have no idea how the system was treated by its previous user(s). Anyways, if ur going to purchase one of the 2 HD consoles, I would do your research on each system's game library. IMO and for my taste, the ps3 has the best games by far. But take a look at both system's games and then decide whether u do or don't want that 360. But then again ur getting it used, so I guess it's not really 360 vs ps3, just 360 or no 360 since u don't have a used ps3 being offered to u. Moving on, if u want it go for it. However, just so u know, 360s do have a very high failure rate. Personally, I don't know a single person who's 360 hasn't crapped out at least once. So def make sure it has a warranty. If not I'd say no way.
