To me, it depends on who owns/originated the IP.
Nintendo owns/originated Punch Out and contracted with Next Level to deliver the product it wanted. Nintendo's game.
HVS designs and shops its own games -- like the Conduit. Sega published it, but HVS is still who gets most credit.
