@Ping_ii and Akuseru Tecmo is the original publisher and developer for the Ninja Gaiden series, they could make whatever they wanted but Microsoft was the first publisher for the Mass Effect series, so we can't compare. If Microsoft published the first game in the Mass Effect series they can have the exclusivity for the entire trilogy (if it was planned since the beggining and Microsoft asked for the exclusivity when they published the game). But hey, everything here is just a guess, good luck for you. Also, Bioshock is a third party game and Microsoft has nothing to do with this game.
