People can't get on Live with a hacked 360, but that doesn't seem to stop (m)any pirates from modding their Xbox.

Unfortunately yes. It boggles my mind how far people will go just so that they could be able to play games for $1 a piece (pretty much the price of each Verbatim DL DVD+R if you buy them in bulk) + 6.8 GB worth of bandwidth. Risking a live ban (which won't allow you to install to the hard drive or transfer save files) or staying off live completely, no access to XBLA games (there is a hack out that allows you to play pirated XBLA games but it's not common and not user-friendly), no patches (though some games have patches available for download on torrent and piracy sites), no free DLC, etc. Then if you are unlucky enough to need repair, there is the possibility that MS will notice you tampered with the console when you send it in for repair.
