Live does not "require" DLC to have a cost. It's just that MS prefers to charge for most of it (as multiple developers have stated that it's MS who decides DLC pricing, not them). Occasionally some of it is free.

For example, Bungie has stated several times in the past that, if it was up to them, the Halo 3 map packs would have been free. But MS decided that, not because it's the publisher of that game, but because they own the system and charge no fees to developers for bandwidth, like Sony does on PSN.

But then, you get the same stuff on PSN at a cost, so it's really not something that MS is particularly evil about. The only thing that can be said is that Live has a user subscription fee to pay for it's expenses, but is free to devs, while Sony keeps PSN free for users, but charges the devs. That's just one of the reasons developers prefer Live.
