Well it gets kinda fuzzy on that one actually. From what I understand the act of backwards engineering encryption is the enforced part. In theory so long as you modded it only to play new software it should be fine as it does not defeat the security measures on the disc. DMCA is a weird, and harmful set of laws. Some of them might be unconstitutional but there are very few Supreme Court cases on it.
