Right of first refusal doesn't mean they get to choose the platform, either.

Actually, from what I understand it does mean that: the publisher has the right to determine what platform a game goes to. That's why Bungie remains a 360-exclusive publisher, despite Microsoft only having a right of first refusal over them. It's also why Bayonetta wound up getting ported to the PS3, despite its developers' complete indifference to the project (Sega simply ported the game itself).
