That IS what the right of first refusal means. But you have to ask how far that right extends: from what I read here, it only means they have that right over the original game. It says nothing about going any further than that.

Right of first refusal doesn't mean they get to choose the platform, either.

"Hey SONY, do you want to publish FF7 on XBLA for us?"

"What? No!"

"Well all right then I suppose we'll do it ourselves"
