The reason the PS3 shots have a greater contrast range is simply because of the expanded colour range setting for HDMI being turned on. The Xbox 360 has the exact same option - only better as it has 3 settings instead of just "onoff". The Xbox 360 has standardintermediateexpanded.

 

The trouble here is that although you get a "juicer" picture with the PS3 set to on as the screenshots show, you're actually losing detail. Just look at Batman's cape for evidence of this, it is virtually just a black texture on the PS3 with the HDMI expanded colour option on.

 

Wheras if Gamespot set the HDMI colour range to "intermediate" on the Xbox 360 they could have achieved a happy medium.

lol well they shouldve then.  I wouldnt care much for texture anyways, especially on Batman's cape, cause you'll be moving most of the time anyways to notice these things.  But color wise is more obvious cause you can see the screen as a whole.  I'd be sure to play a 360 on intermediate setting then next time.  Thanks for the info =)
