Playing MW2 violates ToS of ISPs

No you can't. This violation is on your part, not theirs, and Activision is not inducing you to do anything illegal. You wouldn't have a leg to stand on.

 

Depending on the state, yes you can.  That said, chances are you probably are not in violation of the terms of service of your ISP anyways as it's not being used for commercial purposes.  Check with your ISP.
