Yes it was.  By purchasing you AGREE to the terms of use/terms of service.  By signing up for LIVE you agree to the terms of use/terms of service.  It is explicitly defined in both the manuals that come with the Xbox 360 and the signing up process when you are creating a LIVE account.

lol the manual is inside the box... kinda hard to read the manual without purchasing the xbox. I only agreed to what the salesman told me when i purchased the 360, which was "enjoy your console". Modding a console is perfectly legal in my country, although pirating is not...

Yes and if you open the box, and disagree with the terms you do not have to use it and you can return it.  That is the same with all electronics.

No , if i buy a product i am the owner and i can do whatever i want with it(well as long as i dont break the law) that includes modding the console( i havent though). But different laws apply for Usa though.
