What do you mean by 3d enabled? There is no binary enabled/not enabled option. It's just a matter of whether the console is powerful enough to run it at a decent frame rate and with enough graphical effects to satisfy.
And yes, I suspect next generation 3d gaming will be very similar to blu ray this generation (ie any console with it in will hamstring itself by being too expensive)
I highly doubt Sony has the technology patented. Surely the people who first demoed it would...
I personally wouldn't like Gears or halo no matter how many D's it had (actually, I haven't played either gears game so I might like that even not in 3d)
