As others have said, yes, actually, you can. If you go to a theme park in the USA and proceed to violate their rules (usually safety ones), they can kick you out of the park without any refund. It's a similar idea to XBL. There are rules to follow, and by violating them, you are being "kicked out" early without refund.

Oh, and I'd also agree with suing the pirates, but that becomes harder to prove, unfortunately.

But your example is extremely flawed.

 

For example, you bought 12 tickets to the theme park, and you got banned for them the second time. You.... of course, will be allowed to refund the other 10 tickets.


What the lawsuit is people DEMANDING to refund the fees they paid IN ADVANCE and now can not use.

 

 

Personally, I think Microsoft has any right to ban them, just return the rest of the unaccured money, dude.

This lawsuit is not about banned accounts, it is about banned consoles.  The Live accounts can still be used, just not on the banned console.
