As for the codecs, if M$ doesn't let them use them for PS3/Wii streaming, my guess would be that Netflix would go a different route altogether. Microsoft will probably let them use the codec but they are just trying to drag it out as long as they can. So they can build up a majority of the console use. Its a dick thing to do but I don't blame them. Sony or nintendo would do the same exact thing.
Right now Silverlight is the best streaming codec available and I am sure netflix knows this as well. They would probably be willing to keep it even if microsoft doesn't allow it on the other consoles. I don't know this for certain but I would imagine netflix still streams a lot of material to computers (probably more so than the consoles combined). So they wouldn't want to piss off these users.
There is always something newer and better coming down the road so who knows what tomarrow may bring.
