EA are publishing the second game, the first game was published by Microsoft though.

Your information is incomplete...M$ RETURNED the rights to publish the follow-on games to EA...you think they returned those rights for free?  Is there any logic to giving away rights to a game that is goign to sell 2-3 million copies easily?

Is there any evidence that Microsoft ever had the rights to the Mass Effect franchise to begin with? Simply publishing a game doesn't mean that the company holds the rights to the franchise. If the rights belonged to BioWare then they would have been transfered to EA when they were acquired. Just look at Ninja Gaiden II, Microsoft most certainly doesn't own the rights to the Ninja Gaiden franchise. The same is probably true for Too Human as well. Microsoft published the game, but the title was in development since before the original Xbox was on the market. The rights to the Too Human franchise are almost certainly are with Silicon Knights, not Microsoft.

Silicon Knights may own the franchise, but there's no doubt Microsoft didn't fund that game without a publishing deal intact should they choose to make sequels.
