Indecent exposure is Indecent exposure. If I was walking passed someone's house, I'm on the sidewalk, and I see them naked.. I'd call the authorities.

The point is it was only 5:00am and he probably didnt expect 2 people to be in his garden with binoculars looking through his window.
If it was at 5.00pm then yes, he is at fault but 5.00am is very different.
