You're absolutely right, it's about time there was another one of those big "Customer vs. shop assistant they overheard recomending one product over another" cases.

 

Who would you be pressing charges against, exactly?

Obviously that 16 year old pimple faced kid who said that you can play 95% of the same games on the 360 and PS3 but the 360 is $100 cheaper.  Sue him for not telling you about the hard drive or WIFI adaptor.  I would sue his brothers sisters and parents too.
