I think the literal (dictionary) definition of the term "non-exclusive" shouldnt be applied here..Its like saying something IS THIS because its defined like that...Its important to take all relevant factors into account.

For example:
-I can play this game on PC and its available on 360 (satisfying the legal definition of "non-exlusive")
-But if you take into account factors like the number of PS3 owners who actually bought the PC version, or the relevance of PC to the mainstream gaming community, then the term "console exclusivity" could be applied to this situation without satisfying the legal definition. However that does not mean that we discredit the existance of a PC version.
