TSMC has a 45nm process with all the kinks ironed out available right now, so that's a minimum.
Intel just started collecting the 32nm cpu's off the oven... considering everyone else is at least one year behind Intel and that in order to have a sizeable amount of natal 360's available for christmas... I'm betting on 45nm or a half node intermediate.
