maybe they are just friends of somebody who works at some game-selling shop? They could have paid for it and got it early. I mean they have them in stock, but they are not allowed to sell them right now. I could imagine some people working at retail playing this game or let their friends play it. It is very hard to say which shop "sold" this copy.
Of course some of them pirated it, but certainly not all of them.
Imagine not having GamePass on your console...
