Also the Japanese and others will be forced to create truely creative new games because the chinese will do the rip offs anyway.

How exactly would the Chinese publishers sell their illegal titles (if they make any) to other markets? Region locking and licensing rights make it very easy for Nintendo to prevent that. Of course people with modchips would be able to run them, but those are a minority in western markets.
