Do you think MS would be stupid enough to buy 51% of Rare (Stamper brothers part) if they didn't didn't have an agreement with Nintendo for the other 49%? If Nintendo didn't want to sell their part, MS would never buy Stampers' shares and, in the end, Nintendo would have bought the other 51% for less than half of MS paid (because Stampers really wanted (needed) to sell it.
Honestly, and assuming you know Nintendo's history, do you really think they would miss a super deal like that if they thought it worth it?
