Apperently it is tied to the xbox, not the gamertag. You can transfer the license, but i9t is fairly restrictive in that you cannot transfer it again for a year.

Weird because its definitely tied to my gamertag. When I transfer my account to my friends 360 that doesnt have the dlc maps I can download them and play them just fine. I do this at least once a week too so its not time restricted for me either.
