From my experience, it tie to your gamertag AND console ID. I just recently have MS did license trasfer for me and it only transfer stuff that I bought to my new (refurb) console. My son stuff stay on his console even stuff that I bought on his console with my GT it stay on his console.
Also did you reg. the new console with his gamertag then his stuff should go to his new console.
