I wouldn't trust a refurbished product of any kind, but that's just me, I've had bad experiences with those.
As far as games, besides the ones you mentioned and only including exclusive titles, I would look at:
Warhawk
Motostorm 2
Valkyria Chronicles
Ratchet FTOD
Resistance
Resistance 2
Wipeout HD
SOCOM Confrotation
Singstar
Buzz Quiz TV
I would personally not bother with the 40GB and would get at least a 80GB one or even the 160GB which already comes with Uncharted.
