Well first exactly what they have to do is dependant on the country you live in. Second any BC PS3 now would be only covered under a extended warranty surely?, in which case if you read the fine print they can probably do whatever they like if it's Continuous Play.
People wouldn't pay the price for BC on their PS3's so this was always going to start at some point. The least they could have done though is offered the guy some freebies as compensation for his loss of features.
