They choose when and where to award you the achievement or trophy. If they do it at a bad time or place that is completely their fault and has nothing to do with the achievement system.

Well if 'every' developer puts achievements in the middle of the screen? It might actually be something you want to take up with MS achievements in general. The end result is the same to the consumer (Regardless who is to blame). Sure the developer might have the choice of most things of that nature. But the end result remains the same.
And poor achievement placement is every bit as good of a reason for disliking achievements as I've read for people disliking trophies.
