The only similarity I see between that controller and the other two is the disposition of the four buttons. The rest isn't even close.

 

 Look at the color. Can ninteno sue MS for using the same color buttons? Can Nintendo sue MS for using L/R triggers? Can nintendo sue MS for having analog sticks? Rumble? The answer is no. The answer to the entire thread is no.

I wouldn't be surprised if the answer to the thread is no, but not for the reason you say. There's a big difference between using the same colors and copying almost the whole shape and button layout of a controller.
