Its still wrong. Its like saying "oh I said surprise before I raped her, so it's technically not rape"
You're not allowed to have sex with a non-consenting person. If the person is alseep, or drunk, or not in the right mind, its wrong to take advantage of them. You're also not allowed to mess around with dead people. It's wrong... end of story.
