Slimebeast, if they made the driver open then the kernel devs would update the driver for them. It would require no additional work on AMD's part.
An analogy, on Windows, is when Microsoft says "if you want your drivers to work with future Windows versions, they must be packaged like this, this and this.". Imagine if AMD said, "No, we're doing it THIS way because it suits us. Imagine said drivers broke on the next version of Windows (like many XP ones did on Vista). Would it be MS's fault? No; they TOLD the companies how to make drivers so they would continue to work. If the companies went their own way, it's their fault when it doesn't work out.
