Nintendo was making tons of money back then, with GC/GBA/DS sales. All 3 systems were sold for a profit at the same time.

Nintendo would be fined and sanctioned by anti-monopolist laws in almost every country (look at Microsoft and tell me that Apple/Firefox are weak competitors) and there will always be other companies that will want a slice of their cash-pie. |
Nintendo DID get taken to court a few times over monopolistic business practices in the late 80's and early 90's.
Other companies wanted a slice of the cash pie, but Nintendo made 3rd parties sign contracts where they couldn't make multiplats, and if they did, it had to be Nintendo-exclusive for a year or more. 3rd parties actually signed these contracts, because they had no choice. That's a monopoly.
