It's a liability. Opens up lawsuits possibilities. Minors use XBLA which complicates it.
Putting the burden on the company "we define what's offensive and what not" is dangerous because it means the corporation has to decide what's offensive and what is not, which means a world of hurt. Specially when we are talking about global services... sensibilities are a very tough thing to deal with.
