I'm sure many people with much more legal knowledge than us will be considering this, so you might hear about it in the news, but I doubt it - because this move is to stop IE having a monopoly, and Safari isn't a monopoly.
"give costumers the choice? People go to Mozilla.com and download FF or go to the OPERA page and download that. Windows isn't enabling users from downloading and using whichever browser they want. It's like saying, lets sue MS because I don't like Paint or Notepad."
It's not like this stops you from choosing going to microsoft.com and downloading IE. It's not like saying that thing about paint and notepad, because there isn't the same problem that computer illiterate people are being disadvantaged by them being bundled with the OS. Do you honestly know any graphic designers that are struggling to get ahead in their field because they are using MS paint simply because it's there?
