That's not how it works. EA buying Bioware doesn't mean MS loses whatever rights they had to ME through their own agreement with Bioware. Whatever say MS had in the IP is still there, only now their partner is EA instead of Bioware. Considering that ME was a 1st party published game, most certainly paid for at least in part by MS, and heavily hinted at having a contract in place by multiple parties, EA will need some kind of permisson from MS.
When one company buys another, the buyer (EA) assumes control and responsibility for all of the assets, IPs, debts and contractual obligations that was held by the company being bought (Bioware). So I repeat what has been mentioned multiple times in multiple threads, EA does in fact need MS's permission to do this, or they can be sued.
