MS doesn't own the IP but there was some kind of money exchange between MS/Bioware. Now, no one but MS and EA know what the contract entails in terms of the franchise. As such we are feel to speculate at the fate of ME2/3 and the possiblilty of a ps3 version until EA either confirms/denies the speculation. so far they haven't.
